Fifty Years of Indus Waters Cooperation

The fifty-year span from 1960 to 2010 marked the most consequential period of the Indus Waters Treaty, the bilateral agreement that created the only formal water-sharing regime to survive repeated wars between its signatories. The treaty's durability through the Indo-Pakistani conflicts of 1965, 1971 and 1999, and through the political upheavals of the 1970s military coup in Pakistan and the 1980s emergency government in India, rested on a narrow but resilient foundation: both nations needed water more than they needed military advantage, and neither could unilaterally command the Indus basin without ruinous expenditure.
The treaty divided the Indus and its tributaries into an eastern system allocated to India and a western system allocated to Pakistan. India retained control of the Sutlej, Beas and Ravi; Pakistan received the Indus proper, Chenab and Jhelum. Under the settlement brokered by the World Bank in 1960, Pakistan received the larger volume of water from the mainstem Indus but was permitted no claim on the eastern tributaries, whose damming by India would not violate treaty terms so long as the structures did not divert the water itself from their natural course. The agreement was technical, not political. It named discharge rates, reservoir capacities, notification procedures and dispute mechanisms. Neither government ratified the treaty on the grounds of peaceful coexistence or regional brotherhood. Both did so because the alternative — competing dam construction, conflicting claims, and no agreed measure for determining who was entitled to what — was economically catastrophic to both.
Between 1960 and 1980, the engineering task of the treaty was to establish the infrastructure it had authorized. India constructed the Bhakra dam on the Sutlej, completed in 1963, and the Ravi and Beas systems followed. Pakistan built a succession of link canals designed to compensate for the loss of eastern tributary waters by transferring Indus water into the eastern province canal networks. The Sukkur barrage, built by Pakistan in the 1920s, was reconstructed under treaty provisions in the 1970s. These works, financed partly by World Bank credit and partly by national treasury, proceeded despite the 1965 and 1971 wars. Both wars interrupted construction schedules but did not dissolve the agreement; both nations continued to communicate through the Indus Commission, the joint body established to oversee implementation, and both resumed construction after ceasefire.
The period from 1975 to 1995 saw the first systematic challenge to the treaty's sufficiency. Downstream water availability in Pakistan declined not only because of Indian dam construction but because population growth and agricultural expansion increased demand faster than the treaty anticipated. By 1990, Pakistan's use of Indus water was reaching the limit of what the treaty's allocation permitted, and parts of the lower Indus delta, where the river met the Arabian Sea, were experiencing saltwater intrusion and ecological decline from reduced freshwater flow. A dispute arose over whether India's planned construction of dams on the Chenab and Sutlej tributaries would breach treaty terms. Pakistan argued they would reduce flows below the guaranteed minimums; India argued that the treaty permitted such construction if the water was not diverted. The World Bank conducted a technical assessment in 1994 that vindicated the Indian interpretation but acknowledged that Pakistan faced genuine water stress that might require either population resettlement or new international arrangements outside the treaty's scope.
The treaty functioned through the 1990s but with visible strain. The Kargil War of 1999 occurred without disrupting the Indus Commission's meetings, a fact that surprised observers who had expected that the resumption of fighting would bring the water agreement to collapse. Instead, both militaries observed a tacit boundary: the conflict remained limited to the high Karakoram and Kachemir regions, and both nations continued to honour the discharge and reporting obligations the treaty specified. Pakistani officials later noted in oral testimony that water security mattered more to their nation's survival than the outcome of any single military engagement, and that the treaty had become, paradoxically, more valuable precisely because it created one area of mutual certainty in a relationship otherwise dominated by suspicion.
By 2000, both nations had accumulated sufficient data on water availability and demand to recognize that the next fifty years would face acute scarcity. The International Water Management Institute issued studies in 2002 and 2005 showing that both India and Pakistan were approaching or had passed the point of what hydrologists call "water stress" — using more than 70 percent of renewable supplies and unable to meet peak seasonal demand without depleting groundwater. Neither nation sought to renegotiate the treaty itself, but both began in the 2000s to fund unilateral conservation and irrigation efficiency schemes aimed at making their allocation serve more people. India's adoption of drip irrigation in Rajasthan and Punjab, accelerated after 2005, was justified partly as a development strategy and partly as an implicit acknowledgement that future demands might exceed water supply.
The fifty-year span witnessed the treaty's transformation from a Cold War exercise in technocratic cooperation into the most reliable institutional mechanism between two chronically hostile nations. It did not resolve the underlying conflict or eliminate disputes. But it created a space where both parties had an interest in speaking truthfully about water data, in notifying each other of construction and maintenance work, and in accepting technical arbitration rather than military pressure. Whether such a mechanism could survive the climate shifts that the 2010s would bring remained unresolved.
The treaty established the Indus Commission as a nine-member body, with three delegates from each nation and three from the World Bank. The Commission met regularly to review implementation, to discuss planned water works, and to adjudicate claims of non-compliance. Its meetings were conducted in English and record-keeping was detailed, creating an institutional memory of the agreement's application that survived changes in government and military conflict.
Between 1960 and 2010, the Commission resolved or managed seventeen formal disputes. Most concerned the height of dams or the design of link canals; whether a structure's impact fell within treaty limits required technical measurement and negotiation. India and Pakistan disagreed on six occasions about dam specifications on the Chenab and Sutlej systems, and on one occasion in 1982 Pakistan formally protested the design of the Salal dam upstream on the Ravi. The World Bank's technical personnel evaluated each case and issued written findings. None escalated beyond the Commission itself to become a pretext for political rupture, though Pakistan reserved its objections to the Salal dam and the later Baglihar dam projects formally in the record.
The Commission's structure depended on two factors that might have been otherwise: neither nation appointed the World Bank arbitrators as a humiliation imposed by a powerful outside actor, and both had appointed technical experts rather than military or political figures to represent them. The first chairman, Morrice Lane from the World Bank, served from 1960 to 1976, lending continuity during both wars. His successor, John Waterbury, served through the tensions of the 1980s and 1990s and retired in 2003. Both men were hydrologists with no stake in South Asian politics and no reason to favour either nation over the other. Their authority derived from technical competence and from the fact that both governments had agreed in advance to be bound by technical standards, not political will.
The treaty's primary achievement was not conflict resolution but the enablement of bilateral dam and canal construction that neither nation would have dared undertake without agreed legal cover. Between 1960 and 1990, the two nations invested over 2 billion dollars (at 1990 prices) in hydroelectric dams, barrages, and irrigation systems under the treaty framework. India constructed the Ravi, Sutlej and Beas systems. Pakistan built the Tarbela dam, completed in 1976, the largest earth-filled dam in the world at that time, designed to store water from the Indus in the lee of Indian western tributary development.
The Tarbela project dominated Pakistani water planning through the 1970s and 1980s. With a capacity of 14.3 million acre-feet, it was meant to provide both hydroelectric generation and irrigation supply across the Indus valley. Its construction, financed by World Bank loans and a consortium of bilateral donors, created a coordinating mechanism between Pakistan's planning ministry, the World Bank, and periodic notification to India through the Indus Commission. When construction encountered technical difficulties and cost overruns between 1972 and 1975, Pakistan's request for additional financing required demonstrating to the World Bank that the dam would not exceed treaty limits. The bank conditioned its second tranche of financing on a technical review showing compliance.
India's Bhakra Nangal scheme, planned since the 1950s and completed in three phases between 1963 and 1976, was the larger undertaking in terms of aggregate capacity and complexity. The dam, built on the Sutlej at the edge of Himachal Pradesh, served three Indian states and required negotiating both with those states and with Pakistan's concerns about any reduction in Sutlej flow. The Central Water Commission of India issued detailed flow reports to the Indus Commission quarterly, creating a public record of water availability that Pakistan could verify. When the dam's performance exceeded its designed capacity in particularly wet years, those surpluses flowed downriver to Pakistan unimpeded and were recorded. The practice created an expectation of transparency that became the treaty's operating culture.
